Overview
With the introduction of the Aircraft Registration Act, 2010, Chapter 503 of the Laws of Malta, Malta became the first Member State to accede to the Cape Town Convention and Aircraft Protocol. The Act updated Malta’s aviation legislation creating more visibility of rights and interests in aviation, broadening registration possibilities, as well as creating a far more creditor-friendly environment by facilitating the continued development of finance and operation of aircraft leases. In addition, Maltese legislation offers various tax incentives for operators setting up in Malta.
The regulatory framework is complemented by other Maltese laws and regulations, including but not limited to, the Authority for Transport in Malta Act, Chapter 499 of the Laws of Malta, and subsidiary legislation enacted thereunder, as well as European Union legislation such as Regulation (EU) 2018/1139 of the Parliament and of the Council on common rules in the field of civil aviation and establishing a European Union Aviation Safety Agency.
