Senior Associate Augusto Quintano delivers lecture at University of Malta
Dr Augusto Quintano was invited to deliver a 3-hour lecture at the University of Malta to Masters students as part of the course entitled Gambling Law and Policy in the EU, a postgraduate study-unit.
Overview
This study unit is indeed a captivating one, aiming to familiarise students with gambling law and policy across the EU whilst training students to critically analyse CJEU jurisprudence in this area. Different regulatory approaches adopted by the Member States are discussed, highlighting the fact that the current lack of harmonisation in gambling law and policy in the EU has resulted in a patchwork of national rules and regulations, differing from one country to another.
Dr Quintano’s lecture focused on bringing to light current issues that such non-harmonisation brings about. A key case study presented was the very local context, where during the past two years, Malta gaming licensees have seen an increase in the number of litigation brought forward by foreign individuals claiming the services received to have been illicitly offered in their jurisdiction – notwithstanding the fact that the Malta licence is de facto, a point of supply licence. The interesting interplay between Malta’s recent updates to the Gaming Act (limiting the enforcement of foreign judgements in Malta as such are contrary to Malta’s public policy), Malta’s Constitution, Brussels I and the four fundamental freedoms of the EU, have been examined, compared and contrasted; while reactions from various national competent authorities have been analysed.
