Through the publication of Legal Notice 131 of 2016, changes have been made to the Remote Gaming Regulations, some of which can be considered as key changes and will necessitate action by Licensees.

The following are the salient features of the Legal Notice:

    1. Licensees offering random number generated (RNG) games must now ensure that the return to player (RTP) average is of at least 92%. The Legal Notice enables the Malta gaming Authority to issue directives which set the manner in which licensees must report, certify and comply with this requirement. For the purpose of the RTP calculation, licensees must take into consideration all transactions occuring since the 1st of January 2015.
    2. Licensees must also inform players and make available to them at all times information in relation to any commission or fee held by the licensee, or any fee charged to the player. Such information must include the amount of such commission or fees. At its discretion, if a transitory period is deemed necessary, the authority may exempt licensees from this rule for the first 12 months from this regulation.
    3. The Authority can now require licensees to connect to a monitoring system, as directed and operated by the Authority itself. The licensee shall be bound to maitain the connection at all times and provide for appropriate systems and procedures for this aim, including necessary modifications and upgrades. The information that can be monitored will include those related to games, players and financial data required by the Authority to fulfil its lawful objectives. This will aid the authority in ensuring compliance of the licensees in relation to the applicable laws and regulations.
