Other Types of Gaming Licences

Apart from obtaining a gaming supply licence and a critical supply licence, it is also possible to obtain the following Malta gaming licences from the Malta Gaming Authority.

It is important to note that the below mentioned Malta gaming licences don’t substitute a gaming supply licence or critical supply licence and thus, cannot be obtained instead of these licences. Rather, the corporate group licence and the limited duration licence is a ‘categorisation’ of the gaming supply licence or the critical supply licence.

In the event where the applicant for a licence is a body corporate, such applicant may apply for a Malta gaming licence either for itself only or for its corporate group.

A corporate group is defined under the Gaming Definitions Regulations, 2018 (LN 242 of 2018) as a group of bodies corporate all established in the European Economic Area, or otherwise structured in a manner which provides equivalent safeguards, in which a parent entity exercises control to the extent of over 90% over other bodies corporate in the same group, whether by way of shareholding or voting rights.

Within the group a licence and material gaming supply certificate may be transferred to another entity within the group. The Authority’s prior written approval is however needed.

Where, within a B2C corporate group licence, there are entities that provide a critical gaming supply solely to other entities within the corporate group licence, no B2B licence shall be required. Where entities within a corporate group licence provide critical gaming supplies in or from Malta, or through a Maltese legal entity, to entities outside of the corporate group licence, a B2B licence shall be required.

The Authority may, on application, issue a limited duration licence, the term of which shall be established by the Authority, provided that the Authority may establish further conditions or limitations in a binding instrument.

A limited duration licence is required for gaming services or a gaming supply that, as the name implies, is temporary and consists of a singular event or a number of game instances linked to the same event. In particular, only lotteries and lottery-style games, including progressive lotteries and scratch cards, are eligible to be provided in virtue of a limited duration licence.

The Authority will not issue a limited duration licence that exceeds two (2) months. Moreover, the Authority shall not issue more than four (4) limited duration licences in any calendar year to any one person, whether the person is the operator, organiser or the person or entity on behalf of whom such gaming activity has been organised, or is being organised.
